BRONSON V. RODES

BRONSON V. RODES, 7 Wallace 229 (1868), an action on a New York executor's bond of 1851 to repay a loan "in gold or silver coin." In 1865 the obligor tendered payment in U.S. notes, which Congress had declared "lawful money and a legal tender in payment of debts." The tender was refused, and the obligor sued to cancel a mortgage securing the bond. Decrees in his favor by two state courts were reversed by the U.S. Supreme Court, which held that "express contracts to pay coined dollars are not debts which may be satisfied by the tender of U.S. Notes."
