Doe, John. One of the fictitious characters introduced in a procedure known as ejectment. The writs and remedies available to holders of title in freehold land were not available to leaseholders (i.e. those whose interest in land was limited to a fixed term), who were thus at a disadvantage if they were dispossessed. Through the writ of trespass the common law courts provided leasehold tenants with a remedy, which at first consisted merely of damages against the dispossessor, but later enabled them to recover possession of the leasehold land against the wrongdoer. This remedy, being quick and effective, was attractive to freeholders and, in order to avail themselves of it, they created a fictitious lease involving imaginary characters named John Doe, Richard Roe, and William Stiles. Using this fiction, the two parties to a dispute involving title to freehold land would use ejectment to determine which party had the better right to it.
