STATE REGULATORY INFORMATION
On November 1, 1941, the law governing the licensing of private trade schools in Massachusetts became effective. The law was amended in 1955 and provides that no person shall operate and maintain a private trade school unless he is licensed to do so by the Commissioner of Education. The term "Private Trade School" means a school maintained or classes conducted for the purpose of teaching any trade or industrial occupation for a tuition charge. It does not include private business schools, schools or colleges regularly chartered and authorized by the Commonwealth to grant degrees, endowed schools which offer courses without profit, schools exclusively engaged in training physically handicapped persons, or any schools conducted by one person or corporation for the education and training of their own employees.
The license is valid for one year from the date of issuance and is renewable annually. The law requires the school to advertise under its registered name only, and shall not imply that the school is supervised, recommended, endorsed, accredited, or approved by the State Department of Education. Business: The law that governs the licensing of private business schools is under chapter 75D. The law was amended by Section 1 of chapter 1096 of the Acts of 1971 and amended again in Chapter 674 of the Acts of 1974. It includes schools for medical, dental, and nursing assistants, and tractor-trailer operators. It does not include private business schools, schools or colleges regularly chartered and authorized by the Commonwealth to grant degrees, and endowed schools.
Correspondence: Chapter 652, Acts of 1963, inserts Chapter 75C in the General Laws - Private Correspondence Schools. It provides for licensing of correspondence schools having a place of business in the Commonwealth. Correspondence schools from out-of-state must register with the Commonwealth.
Agents or representatives of any correspondence school doing business in the Commonwealth must be interviewed, licensed, and must provide a surety bond.
All of the above types of schools are required to file with the Department of Education a list of courses advertised and a list of tuition charges for each separate course. As established courses are discontinued, notice of the fact with the effective date, must be given to the Department within ten days of each planned discontinuance.
Advertising media must be reviewed by the Department of Education before being used. All private schools advertising must include the notation, Licensed by the Commonwealth of Massachusetts - Department of Education.
Each school is required to file with the Department of Education a statement giving training and experience of each member of the teaching staff, including both full-time and part-time teachers. All instructors employed must be competent in a subject, course, or trade. Changes in personnel must be brought to the attention of the Department of Education for acceptance.
Private school curriculum must be provided to the Department of Education, Office of Private Schools.
All private school facilities must meet local building and fire inspection codes and the requirements of Chapters 93 and 75D of the General Laws of the Commonwealth for schools.
Standard tuition rates shall be published in the school literature, and no deviations from the rate other than for cash payment in advance is permissible. Notification of change in tuition rate must be given 30 days in advance to the Department of Education. Schools using a retail installment contract must have it approved by the Banking Commissioner of Massachusetts and by the Department of Education.
Each school operating in the State shall file with the application for licensing statement of its financial condition on a form acceptable to the Department of Education and the Office of the State Auditor.
Listed business schools and resident licensed correspondence schools must provide a surety bond.
